Allegations against People in Positions of Trust
Some allegations may indicate that a risk could be posed to an adult, or adults, with care and support needs by a person in a position of trust that fall outside the framework of S42 of the Care Act 2014. This is because some allegations do not indicate alleged abuse or neglect of specific adults with care and support needs, but they still indicate that a person may not be suitable to work with adults with care and support needs.
Examples of such concerns include (but are not limited to) allegations that a person in a position of trust has:
- Behaved in a way that has abused, or may have abused an adult or child.
- Possibly committed a criminal offence against, or related to, an adult or child
- Behaved towards an adult, or child, in a way that indicates they may pose a risk of harm to adults with care and support needs.
This process is for all employers, voluntary organisations and student bodies in Newham who engage with adults with care and support needs of any kind.

If the concern involves harm to an adult at risk, also make an adult safeguarding referral
If the concern relates to a potential risk to children, you must notify the Local Authority Designated Officer (LADO).
Where a person is removed from their role providing a regulated activity following a safeguarding incident, the regulated activity provider or agencies and personnel suppliers will need to be mindful of their duties to refer to the Disclosure and Barring Service and/or professional regulation authority.
