Terms and Conditions for Green and Garden Waste Collection

By using our service, you agree to adhere to these guidelines and ensure that your garden waste is prepared and placed as specified for a smooth and efficient collection process.

These terms and conditions (the 'Terms') shall govern the provision of garden waste collection services (the 'Service') by the London Borough of Newham (hereinafter referred to as 'Council' or 'we') to you (hereinafter referred to as 'you' or 'Customer').

By subscribing to the Service, you agree to be bound by these Terms and Conditions:

1. The Service is offered on both an annual subscription and a pay per collection basis.

2. The current fee schedule for the Service shall be as published on Council website, and Council reserves the right to modify such fees at its sole discretion.

3. The fees are applicable for the period from March 1 to October 31 of each calendar year.

4. Payment of the Service fees must be paid in advance; and the fees are non-refundable.

5. Payment methods accepted include online transactions via debit card or credit card.

6. The Service will be available on weekdays only, from March 1 to October 31. The Service provider will aim to complete collections within five days, although delays may occur due to public holidays, bank holidays or other exceptional circumstances.

Subscription

7. If a Customer has scheduled a garden waste collection under a subscription plan, they may not book another collection until a minimum of two (2) full weeks have passed from the date of the prior booking.

However, Subscription Customers may choose to book Pay per Collection services, subject to the Pay per Collection terms and the standard fee.

Pay per Collection

8. For Pay per Collection bookings, after scheduling a garden waste collection, the Customer must wait at least one (1) full week before scheduling another. Also, only one active booking is allowed at a time.

9. Upon booking, you must ensure your garden waste is made available at the front boundary of the property, is clearly visible and ready for collection. All bags must be clearly visible and accessible. If the waste is not properly presented, it will be deemed non-compliant, and the collection will be marked as complete without collection.

10. The Customer must ensure that no garden waste is placed on the pavement or public pathways to avoid obstruction.

11. The Customer must use black bags only, ensuring they are not overfilled or too heavy. All waste must be fully contained, and the bag must be securely tied with no items protruding. The black bags must be strong enough for safe handling. If the waste is not properly presented, the Service will not collect it, and no refund will be given.

  • Green garden waste must be placed loosely in the black bag.
  • The inclusion of plastic bags inside black bags is strictly prohibited.

12. Black bags with unacceptable materials will not be collected. The Customer is responsible for removing any contamination before the next scheduled collection. Continued non-compliance with these terms may lead to termination of the Service, with no refunds granted.

13. Details on acceptable garden waste items are provided on our website.

14. The Service only covers the removal of garden waste in black bags. Waste in any other container or bag will not be collected.

15. Additionally, each collection is limited to a maximum of six (6) black bags.

16. Any bags beyond the permitted six (6) per collection will not be collected. The Customer must schedule a new collection for any additional waste.

Missed Collection Reporting
Missed collections must be reported to the Council after five (5) working days have elapsed and before the close of the eighth (8th) day from the scheduled collection. Newham Council reserves the right to refuse a missed collection report received outside of this timeframe or where non-collection is attributable to the waste being improperly presented, contaminated, or overweight in accordance with these Terms.

Change of Address
The Customer must promptly notify the Council of any change in address to enable:

  • Amendment of the Customer’s application details and continuation of the Service at the new eligible address; or
  • Cancellation of the Service if the Customer is no longer a resident within the eligible area.

Notification of Address Change
The Customer may notify the Council of a change of address online by logging into their MyNewham account.

Cancellation
Cancellations of either Pay per Collection or subscription services shall not be eligible for a refund, unless the Service is cancelled within 14 days of purchase. Requests for this cancellation and refund need to be sent to recycling@newham.gov.uk.

If the Service has been used prior to cancellation within this period, a refund will be issued, minus a £5 fee.

Termination for Breach
The Council may, at its sole discretion, cancel the Service immediately by providing written notice to the Customer, if the Customer materially breaches any provision of these Terms and fails to remedy such breach within seven (7) working days of receiving written notice from the Council.

Force Majeure and Service Suspension.
If any act, event, or omission beyond the reasonable control of the Council prevents, hinders, or delays the performance of the Service, the Council may suspend the Service until such time as performance becomes practicable within its current resources. Should any such suspension continue for more than four (4) consecutive collection instances, either party may terminate the Service by providing written notice to the other with immediate effect. In such event, the Council shall refund a pro-rata portion of the Service fees for the period of suspension.

Residential Service Limitation
The Service is provided exclusively to residential properties within Newham. Commercial properties and non-domestic activities are expressly excluded.

Registered Property Use
The garden waste collection service is intended solely for the registered property. Utilisation of the Service to collect waste from other properties or businesses is prohibited and may result in termination of the Customer’s service access.

Business-Related Waste
Newham shall not collect garden waste identified as being generated by a business operating from a residential property. In the event that business-related garden waste is included in the collection, the Council reserves the right to refuse the Service and may initiate enforcement action against the Customer. Landlords or HMOs requiring waste collection services must instead arrange for a bulky waste collection.

Transfer of Ownership
Upon collection, all garden waste shall become the property of the Council, and thereafter, the property of East London Waste Authority and its designated waste disposal contractor, Biffa.

Amendments

The Council reserves the right to amend these Terms at any time. The Council reserves the right to amend these Terms at any time. If amended, the new Terms and Conditions will be published on the Council’s website.
